Messaging Terms of Service

These Mobile Messaging Terms of Use (the "Terms") govern the text messaging program (the "Program") operated by James T. Borello & Co. ("JTB," "we," "us," or "our"), a registered investment adviser, FINRA-member broker-dealer, and tax preparation practice located at 151 Dundee Avenue, East Dundee, Illinois 60118. The Program delivers messages via SMS and Rich Communication Services (RCS). By enrolling in the Program, you accept these Terms.

1. Program Description

Message frequency varies based on your engagements with us and is typically higher during tax season (January through April).

You enroll in the Program by providing your mobile number and written consent during client onboarding or by other means we make available. Consent to receive messages is not a condition of engaging JTB for any service. By enrolling, you represent that you are the account holder or customary user of the mobile number provided and that you are at least 18 years of age. You agree to notify us promptly if you change or relinquish your mobile number.

You may opt out at any time by replying **STOP** to any message from us. After you opt out, you will receive a single confirmation message and no further messages will be sent, except as needed to confirm your opt-out. You may re-enroll at any time by contacting us or replying **START**. Opting out of messaging does not affect your client relationship with JTB; we will continue to communicate with you by other means.

JTB does not charge for the Program. However, message and data rates may apply from your mobile carrier based on your service plan. You are responsible for all such charges.

6. Carrier Disclaimer

Wireless carriers supported by the Program are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your carrier and network availability, and is not guaranteed by JTB or by any carrier.

7. Important Notice Regarding Instructions and Time-Sensitive Matters

**Do not use text messaging to transmit securities orders, trade instructions, funds transfer or disbursement requests, or other time-sensitive instructions.** JTB will not act on transaction instructions received by text message. Such instructions must be communicated by the methods described in your account or engagement documents. Messages sent through the Program are for informational and administrative purposes only and do not constitute investment, tax, or legal advice.

8. Recordkeeping

As a registered broker-dealer and investment adviser, JTB is required to retain business-related communications, including text messages sent and received through the Program, in accordance with applicable SEC and FINRA recordkeeping rules. By using the Program, you acknowledge that your messages with us will be retained.

9. Privacy

Information collected in connection with the Program is handled in accordance with our Privacy Policy, available at https://www.jamestborello.com/privacy. We do not sell your mobile number, and we do not share your mobile number or messaging consent with third parties for their marketing purposes. Mobile information may be shared with service providers (such as our messaging platform provider) solely as necessary to operate the Program.

10. Eligibility and Availability

The Program is intended for use within the United States on participating carriers. We may suspend or terminate the Program, or your participation in it, at any time without notice.

11. Disclaimer and Limitation of Liability

The Program is provided on an "as is" basis. To the fullest extent permitted by law, JTB disclaims all warranties regarding the Program and will not be liable for any delay or failure in the delivery, receipt, or processing of any message, or for any unauthorized access to messages resulting from circumstances outside our reasonable control. Nothing in these Terms limits any right or protection you may have under applicable federal or state securities laws.

12. Changes to These Terms

We may update these Terms from time to time. The current version will always be posted at this page, and material changes will be identified by an updated "Last updated" date. Your continued participation in the Program after changes take effect constitutes acceptance of the revised Terms.
